DAD STRONG // PRACTICAL GUIDE

Parental Relocation and Custody.

Relocation disputes are highly state-specific. A move that affects parenting time may require notice, consent, or court approval before the child moves.

Educational information only. Family-law rules and court procedures differ by state. This is not legal advice and does not create an attorney-client relationship.

Read the order and state law

Look for geographic restrictions, notice requirements, travel terms, school provisions, and relocation procedures. Do not assume an adult's ability to move automatically permits moving the child.

Track every deadline

Notice and objection deadlines can be short. Preserve the notice, delivery proof, proposed move date, and any court papers.

Evaluate the child's practical needs

Consider school continuity, childcare, medical care, family relationships, activities, travel time, costs, and the child's developmental needs.

Prepare alternate schedules

If distance increases, propose realistic blocks of time, holidays, summers, transportation responsibility, travel costs, and remote communication.

Document without escalating

Keep communications factual and do not threaten to take or hide the child. Follow existing orders while obtaining legal guidance.

Address interstate jurisdiction

If states are changing, custody-jurisdiction law may affect where a case belongs. Consult a lawyer familiar with interstate custody issues.

Preparation checklist

  • Current custody order
  • Relocation notice
  • Deadline calendar
  • School and travel comparison
  • Alternative schedules
  • Transportation budget
  • Local legal advice

Where to verify the rules

Use your official state court website and local court self-help center for current forms and procedures. You can also search LawHelp.org and the Legal Services Corporation directory for local legal-aid options.
