Legal custody
The right to make major decisions for the child (education, health care, religious upbringing) — sole or joint.
Physical custody
Where the child lives and the schedule.
Visitation
The time a non-custodial parent has with the child.
Best interests
The standard; decided on all relevant factors (Ala. Code § 30-3-152).
Core rules
- Alabama uses 'custody' (sole/joint legal and physical) plus 'visitation'
- If both parents request joint custody, the court presumes joint custody is in the child's best interest and shall grant it unless specific written findings are made (Ala. Code § 30-3-152(c))
- The court shall order the form of custody in the child's best interest
- There is no statewide rebuttable presumption of joint custody in contested cases as of the review date
- A good-parent / stability analysis and the child's needs guide the decision
Support and modification cautions
Alabama uses the Income Shares model for child support (Rule 32, Ala. R. Jud. Admin.) — not a flat percentage. Custody may be modified on a material change in circumstances plus best interest; child support on a 10% variance presumed material change.
