Core rules
- Iowa uses 'custody' (legal) + 'physical care' (where the child lives) + 'visitation'
- The court considers the child's best interests with maximum continuing contact with both parents (Iowa Code 598.41)
- Joint legal custody is favored unless clear and convincing evidence shows it is unreasonable
- Joint physical care = both parents share equal and regular care (Iowa Code 598.1(4))
- A history of domestic abuse creates a rebuttable presumption against joint custody
- No preference to mother over father (or vice versa) based on gender
- Cases are heard in District Court
Support and modification cautions
Iowa uses the Income Shares model (Iowa Court Rules, Chapter 9). Custody / physical care modification needs a substantial change in circumstances plus best interests.
