Legal custody

The right to make major decisions for the child (medical, religious, educational).

Physical custody

Where the child actually lives and receives day-to-day care — sole, primary, shared, partial, or supervised.

Shared / primary / partial custody

Shared (each has significant time), primary (majority of time), or partial (less than a majority).

Best interests

The standard; decided on all relevant factors with substantial weight given to the child's safety (23 Pa.C.S. § 5328).

Support and modification cautions

Pennsylvania uses the Income Shares model for child support — not a flat percentage of one parent's income. The court combines both parents' net income and reads the basic obligation from the schedule (Pa.R.C.P. 1910.16), adjusted for shared custody time (40%+ overnights) and add-ons. A custody order may be modified upon petition when it serves the child's best interests, typically on a substantial change in circumstances.
