Core rules
- Idaho uses 'custody' (legal + physical, sole/joint) + 'parent-time'
- The court decides based on the child's best interests (I.C. 32-717)
- Joint physical custody means significant periods with each parent; equal time is not required
- The court considers the child's wishes and the child's adjustment to home/school/community
- Domestic violence is a factor in custody decisions
- Cases are heard in District Court (including the magistrate division)
Support and modification cautions
Idaho uses the Income Shares model under the Idaho Child Support Guidelines (IRFLP Rule 120, eff 7/1/2025). Existing custody orders may be modified only on a substantial and material change of circumstances plus best interests.
