Core rules
- Kansas uses 'legal custody' (joint/sole) + 'residency' (where the child lives) + 'parenting time'
- The court decides based on the child's best interests (KSA 23-3203)
- There is no presumption in favor of either parent based on gender (KSA 23-3204)
- A written parenting plan agreed by both parents is presumed in the child's best interests (rebuttable)
- Joint legal custody means equal decision rights (KSA 23-3206)
- Residency may be joint (child alternates) or sole (one parent has primary; the other has parenting time)
- Cases are heard in District Court
Support and modification cautions
Kansas uses the Income Shares model under the Kansas Child Support Guidelines. Orders may be modified on a material change of circumstances plus best interests.
