Many custody problems come from avoidable conduct outside the courtroom. Protect your credibility by being consistent, calm, prepared, and focused on your child's needs.
Ignoring the current order
Follow the existing order unless the court changes it or a genuine emergency requires immediate lawful action. Keep proof of compliance and address disputes through the proper process.
Sending angry messages
Assume every text, email, and voicemail could be reviewed in court. Pause before responding and keep communication brief, factual, and child-focused.
Posting the case online
Do not discuss allegations, negotiations, the other parent, the judge, or the child on social media. Privacy settings do not guarantee privacy.
Using children as messengers
Do not question children for evidence, pressure them to choose, or ask them to deliver adult messages. Shield them from litigation whenever possible.
Collecting evidence unlawfully
Recording, account access, tracking, and disclosure laws vary. Do not guess. Ask a licensed attorney before recording conversations or accessing information that is not yours.
Missing deadlines
Track service, filing, disclosure, mediation, evaluation, and hearing dates in one calendar. Late filings can be excluded or dismissed.
Making a vague proposal
Bring a specific parenting plan that addresses school, transportation, holidays, communication, childcare, and decision-making.
