DAD STRONG // PRACTICAL GUIDE

How to Prepare for a Custody Hearing.

A custody hearing is easier to follow when your facts, exhibits, and requested orders are organized around the issues the judge must decide.

Educational information only. Family-law rules and court procedures differ by state. This is not legal advice and does not create an attorney-client relationship.

Read every court notice

Confirm the hearing type, date, location or video link, filing deadlines, time limits, and whether witnesses or exhibits are allowed.

Define the decision you need

Write the exact outcome you are requesting. Separate temporary issues from final issues and connect each request to your child's safety, stability, and routine.

Create a short timeline

List the most important events by date with a citation to the supporting document. Remove events that do not affect the issue before the court.

Prepare exhibits

Label and index proposed exhibits in the court's required format. Bring the required number of copies and preserve originals.

Prepare testimony

Practice concise answers based on firsthand knowledge. Listen to each question, answer it directly, and do not argue with the other party or the judge.

Plan the day

Arrive early, dress neatly, silence devices, arrange childcare, and have paper copies available even if electronic filing is used.

Confirm local procedure

Courtroom practices differ. Review your court's self-help instructions or speak with a local attorney before the hearing.

Preparation checklist

  • Hearing notice
  • Requested orders
  • One-page timeline
  • Parenting plan
  • Exhibit list and copies
  • Witness contact list
  • Notebook and pen

Where to verify the rules

Use your official state court website and local court self-help center for current forms and procedures. You can also search LawHelp.org and the Legal Services Corporation directory for local legal-aid options.
