Social Media Mistakes During a Custody Case.

Social posts can be copied, shared, misunderstood, or requested in discovery. The safest approach during active litigation is usually to post less and never discuss the case.

Do not discuss the case

Avoid allegations, hearing updates, settlement positions, documents, witnesses, attorneys, court staff, and judges.

Protect children

Do not post sensitive schedules, locations, school details, medical information, or content that embarrasses or pressures a child.

Avoid indirect attacks

Memes, vague accusations, hashtags, and comments by friends can still be connected to the dispute.

Do not destroy content

Deleting material after litigation begins can create preservation problems. Ask an attorney before removing or altering relevant content.

Review tags and privacy

Limit tagging, location sharing, public friend lists, and third-party app access. Privacy settings reduce exposure but do not make posts confidential.

Ask others not to post

Politely request that friends and relatives avoid discussing the case or posting the child without permission.
