Temporary orders involving children
South Carolina does not promise same-day rulings on any private interim filing. Emergency hearings are limited. Use the Family Court interim procedure and county forms, and confirm the receiving court's local intake and deadlines.
A parent can request interim custody / visitation through the Family Court procedure. For an immediate threat, an Order of Protection petition is a separate, faster route.
Orders of Protection (SC Code § 20-4-10)
A South Carolina Order of Protection is issued under SC Code § 20-4-10 in Family Court. There is no filing fee. The court may hold an emergency hearing within 24 hours of service. A final order may last up to one (1) year. Filing a false petition is a felony. Obey every term; only the court can change it.
South Carolina child protective (DSS)
Reports of suspected abuse or neglect go to the SC DSS at 1-888-227-3487 (1-888-CARE4US) or 911 for immediate. A report can lead to a CPS investigation; an unfounded report does not prove it was knowingly false and does not by itself end custody or visitation.
