Temporary orders involving children

Wisconsin does not promise same-day rulings on any private interim filing. Ex parte orders are limited. Use the Circuit Court interim / emergency procedure and county forms, and confirm the receiving court's local intake and deadlines.

A parent can request temporary physical placement / legal custody through the Circuit Court procedure. For an immediate threat, a Domestic Abuse Injunction petition is a separate, faster route.

Domestic Abuse Injunctions (Wis. Stat. § 813.12)

A Wisconsin Domestic Abuse Injunction is issued under Wis. Stat. § 813.12. A court issues a temporary restraining order that is in effect until a hearing on the injunction is held; the hearing must be held within 14 days after the TRO is issued (subject to extension). A final injunction may be granted for up to 4 years. Obey every term; only the court can change it.

Wisconsin child protective (county / DCF)

Reports of suspected abuse or neglect go to the county child welfare / DCF where the child lives or to local law enforcement. A report can lead to a child protective investigation. An unfounded report does not prove it was knowingly false and does not by itself end custody or placement.
