Temporary orders involving children
South Dakota does not promise same-day rulings on any private interim filing. Emergency hearings are limited. Use the Circuit Court procedure for interim relief and confirm the receiving court's local intake and deadlines.
A parent can request an interim custody order through the Circuit Court procedure. For an immediate threat, a protection order is a separate, faster route.
Protection orders (SDCL ch. 25-10)
South Dakota's protection order is filed under SDCL ch. 25-10. A temporary protection order generally lasts up to 30 days (subject to good-cause continuance). A final protection order lasts up to five years. Relief may restrain abuse, exclude the abusing party, award temporary custody/visitation, establish temporary support, order counseling, and provide other necessary protection.
South Dakota child protective (DSS CPS)
Reports of suspected abuse or neglect go to South Dakota Department of Social Services, Division of Child Protection Services (CPS); call 911 for immediate. The CPS reporting number is 877-244-0864, available Monday–Friday, 8 a.m.–5 p.m. For emergencies or after-hours immediate danger, contact local law enforcement or 911. An unsubstantiated report does not prove it was knowingly false and does not by itself end custody.
