Temporary orders involving children

Nebraska does not promise same-day rulings on any private interim filing. Emergency hearings are limited. Use the District Court interim procedure and forms, and confirm the receiving court's local intake and deadlines.

A parent can request an interim custody order through the District Court procedure. For an immediate threat, a domestic abuse protection order is a separate, faster route.

Domestic abuse protection order (Neb. Rev. Stat. 42-924)

Nebraska's domestic-violence protective order is the domestic abuse protection order, filed in District Court under the Protection from Domestic Abuse Act. An ex parte order may issue on a showing of immediate danger. The respondent has 10 days to request a hearing; if none, the order becomes final and lasts 1 year, renewable annually (renewal within 45 days). It may grant temporary custody up to 90 days. There is no filing fee.

Nebraska child protective (DHHS)

Reports of suspected abuse or neglect go to Nebraska DHHS at (800) 652-1999 (24/7), or 911 for immediate. Nebraska law imposes a duty on anyone who has reason to believe a child has been abused or neglected to report. An unsubstantiated report does not prove it was knowingly false and does not by itself end custody or parenting time.
