Temporary orders involving children

Mississippi does not promise same-day rulings on any private interim filing. Emergency hearings are limited. Use the Chancery Court interim procedure and forms, and confirm the receiving court's local intake and deadlines.

A parent can request interim custody / visitation through the Chancery Court procedure. For an immediate threat, a Domestic Abuse Protection Order petition is a separate, faster route.

Domestic abuse protection orders (Miss. 93-21-15)

Mississippi's primary domestic-violence protective order is under Miss. Code 93-21-15. Ex parte orders last up to 10 days; a temporary order lasts up to 30 days (or up to 1 year if the parties have no minor children in common); a final order is set by the court, commonly up to 1 year and renewable, entered in the Mississippi Protection Order Registry. There is no filing fee in most cases. Obey every term; only the court can change it.

Mississippi child protective (MDCPS)

Reports of suspected abuse or neglect go to MDCPS at 1-800-222-8000 (statewide 24/7) or online, or 911 for immediate. Mississippi law imposes a duty to report for mandated reporters (Miss. 43-21-353). An unsubstantiated report does not prove it was knowingly false and does not by itself end custody or visitation.
