Temporary orders involving children

Missouri does not promise same-day rulings on any private interim filing. Ex parte orders are limited and the court and the county matter. Use the Circuit Court interim / emergency procedure and county forms, and confirm the receiving court's local intake and deadlines.

A parent can request interim custody / parenting time through the Circuit Court procedure. For an immediate threat, an Order of Protection petition is a separate, faster route.

Orders of Protection (RSMo Ch. 455)

A Missouri Order of Protection is issued under RSMo Chapter 455. A court can issue an ex parte order of protection without notice to the respondent; there is no filing fee. After service, the court schedules a full order hearing (typically within about 15 days of service). At the hearing the petitioner must prove abuse by a preponderance of the evidence. A full order typically remains in effect for up to one year. Obey every term; only the issuing court can change it.

Missouri child protective (Children's Division)

Reports of suspected abuse or neglect go to the Missouri Child Abuse and Neglect Hotline at 1-800-392-3738 (24/7) or to local law enforcement. A report can lead to a Children's Division child protective investigation. An unfounded report does not prove it was knowingly false and does not by itself end custody or parenting time.
