Temporary orders involving children

Georgia does not promise same-day rulings on any private interim custody filing. Use the Superior Court interim / emergency procedure and county forms, and confirm the receiving court's local intake and deadlines.

A parent can request interim custody through the Superior Court procedure. For an immediate threat, a Family Violence Protective Order (FVPO) petition is a separate, faster route.

Family Violence Protective Order (FVPO)

A Georgia FVPO is issued under O.C.G.A. 19-13-1 et seq. A judge can issue a temporary order ex parte where probable cause exists; a full hearing follows within 10 days (not later than 30 days). A final FVPO can last up to 1 year, extendable up to 3 years or permanent. Obey every term; only the issuing court can change it.

Georgia child protective (DFCS)

Reports of suspected abuse or neglect go to the Georgia Division of Family and Children Services (DFCS) at 1-855-422-4453 (24/7); call 911 for an immediate emergency. A report can lead to a DFCS Child Protective Services (CPS) investigation. An unfounded/expunged report does not prove it was knowingly false and does not by itself end parenting time.
